1. About these terms

These terms govern your use of zmbutilities.com (the "site"), operated by ZMB Utilities LLC ("ZMB Utilities," "we," "us"), 8854 N Chester Ave, Unit 3NW, Niles, IL 60714. By using the site, you agree to these terms. If you use the site on behalf of a company, you confirm that you are authorized to do so. If you do not agree, please do not use the site.

2. Information only, not an offer

The site describes our services in general terms. It is not an offer, quote, bid or warranty, and sending a quote request does not obligate you or us. Price, scope, schedule, insurance, warranty and all other commercial terms apply only when a written proposal or contract signed by both parties sets them out, and that agreement controls over anything on the site. Illustrations and descriptions show typical work and do not guarantee results on any particular project.

3. Information and documents you send us

When you submit a form or share a link, you confirm that the information is accurate and that you have the right to share it, including any prints, drawings or documents the link opens. Please do not send information you are not allowed to disclose. We use project documents to review your request and prepare a response, and we handle personal information as our Privacy Policy describes. Sending an application does not create an employment relationship or guarantee an interview.

4. Acceptable use

You may not:

  • send spam or automated submissions;
  • submit false information or impersonate anyone;
  • try to gain unauthorized access to the site, probe or test its security, or get around its protections;
  • interfere with how the site works;
  • scrape or harvest content or data by automated means, except for ordinary search-engine indexing;
  • link to or send malicious code; or
  • use the site for anything unlawful.

5. Intellectual property

ZMB Utilities LLC or its licensors own the ZMB Utilities name and logo and the text, illustrations and design of the site, which the law protects. You may view the site and share links to it. Any other copying, changing or reuse requires our written permission. Other names and marks belong to their owners.

6. Third-party services and links

We provide links to third-party websites and services — including file-sharing services you may use to share prints — for convenience only. We do not control them and are not responsible for their content, security or practices.

7. Disclaimer

The site and its content are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the site will be uninterrupted, error-free or free of harmful components. Information on the site is general and is not engineering, safety or legal advice for your project.

8. Limitation of liability

To the fullest extent the law allows, ZMB Utilities LLC and its members, managers, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising out of or related to your use of the site or your inability to use it. Our total liability for any claim arising out of or related to the site is limited to one hundred U.S. dollars (US$100). This section covers use of the site only. It does not change any written agreement between you and us, and it does not limit liability that the law does not allow us to limit.

9. Governing law and venue

The laws of the State of Illinois govern these terms and any dispute arising out of or related to the site, without regard to conflict-of-law rules. Any such dispute must be brought only in the state courts located in Cook County, Illinois, or in the United States District Court for the Northern District of Illinois, and you and we consent to the personal jurisdiction of those courts. This section does not apply to disputes under a written agreement that has its own dispute-resolution terms.

10. Changes

We may update these terms, or change, suspend or discontinue the site, at any time. Changes take effect when we post them with a new date at the top of this page. If you keep using the site after a change, you accept the updated terms.

11. General

If any part of these terms is found unenforceable, it will be enforced as far as the law allows, and the rest stays in effect. If we do not enforce a provision, we have not waived it. These terms and our Privacy Policy are the entire agreement about your use of the site; for the matters it covers, a signed written agreement between you and us takes precedence. You may not assign these terms; we may assign them to a successor. Headings are for convenience only.
